A truck driver recently hit an Orange County crossing guard who was assisting a child cross the street, according to the Florida Highway Patrol.
Florida Troopers reported that 78-year-old crossing guard Margarita Martinez was in a crosswalk with a child on Chickasaw Trail shortly after 8 am when a Chevrolet pickup driver made a right turn and hit her.
Thankfully Martinez only suffered minor injuries, and the child was not injured.
The truck driver, 57-year-old Joel Garcia, was not injured. He was ticketed for failure to yield to a pedestrian in a crosswalk.
Martinez has served as a crossing guard since November 2002.
“Crossing guards play an important role in keeping our children safe to and from school while crossing intersections. We would like to urge people to slow down and drive extra cautiously, especially in school zones," an Orange County Sheriff’s Office spokesperson said.
In these types of situations an experienced attorney can be extremely valuable in clarifying whether damages are appropriate and if a lawsuit is possible.
Determining the amount of damages in these very sensitive situations should be left to an attorney that understands and has years of experience being an advocate for the people in the community.
