A DUI can be categorized as a misdemeanor or as felony. Minimum penalties are well defined and include probation, a fine, certain classes and a mandatory suspension of driving privileges, and impoundment of the vehicle. These minimum penalties grow in seriousness if the individual has prior DUI’s, damages property, injures or kills someone. This last scenario is called DUI Manslaughter and is an extremely serious felony often met with very severe penalties including prison time.
