How Long Do I Have To File a Car Accident Claim?

In Florida, there are time limits to file a claim, and these are set by the statute of limitations. You will need to settle or file your claim by these limits to ensure that the claim opportunity is not lost.

Wrongful death claims must be filed within two years from the time of accident. Four year limits include injury accidents involving a minor, accidents involving government vehicles and claims for underinsured or uninsured motorist.

Also note that government vehicle accidents require a notice of claim to be filed within three years of the accident. These rules apply only to accidents in Florida, and these limits can change, so be sure to consult a lawyer. Watch the video to learn more.
