The answer to this situation depends on different factors. Let’s start by noting that inheritances in Florida are legally not considered marital property.

By law, an inheritance does not have to be considered in a divorce case.However, if one of the spouses gets and inheritance while married, it could be that he or she uses the money to pay for marital expenses or to pay the mortgage. This is what could make things complicated along the way if there is a divorce.

Depending on different factors, the court could determine that the inheritance that was previously nonmarital property has, in fact, turned into property that belongs to the two spouses.If so, it could then be divided between the parties.Watch the video to learn more.
