Woman Killed In Kissimmee Motorcycle Accident

MotorcycleAccident32

Motorcycles offer a lot of freedom but they lack safety characteristics. A rear-end accident involving a motorcycle can easily result in death.

Sadly, this was recently the case in Kissimmee. A Kissimmee woman was killed in a two-vehicle crash on South Orange Blossom Trail. The fatal accident occurred on the morning of December 13.

A Suzuki GFSX-8S motorcycle, driven by a 30-year-old Orlando man, and a Buick Enclave, driven by a 54-year-old St. Cloud woman, were both headed south on Orange Blossom Trail. The Enclave failed to slow down for the motorcycle in front of it and caused a rear-end crash.

The two drivers, as well as a 27-year-old woman who was a passenger on the motorcycle, were injured and taken to HCA Florida Osceola Hospital. The passenger later died. The crash is still under investigation.

Motorcycle Rear-End Accidents

Motorcycle rear-end accidents are among the most dangerous types of crashes because riders have little physical protection and limited ability to absorb impact. These collisions often occur at intersections, in heavy traffic, or during sudden stops, and they frequently result in serious or catastrophic injuries.

Rear-end motorcycle crashes are often caused by distracted driving, following too closely, speeding, or a driver misjudging a motorcycle’s stopping distance. Motorcycles can stop more quickly than passenger vehicles, and drivers who are not paying close attention may fail to react in time. Poor visibility, aggressive driving, and impaired driving also contribute to these accidents.

In many cases, the driver who strikes a motorcycle from behind is presumed to be at fault. However, insurance companies may attempt to shift blame by arguing that the rider stopped suddenly, lacked proper lighting, or engaged in unsafe riding behavior. Evidence such as traffic camera footage, witness statements, and accident reconstruction can be critical in establishing fault.

Rear-end impacts can throw riders from their motorcycles, leading to traumatic brain injuries, spinal cord damage, broken bones, road rash, and internal injuries. Victims may seek compensation for medical expenses, lost income, pain and suffering, and long-term rehabilitation costs.

Keep in mind that Florida follows a pure comparative negligence system. This means that even if a motorcyclist is partly at fault for a rear-end collision, they can still recover damages. However, their compensation will be reduced by their percentage of fault. For example, if a rider is found 20% responsible, their damages award will be reduced by that amount.

Also, motorcyclists should be doing everything possible to stay safe. Florida law requires motorcycles to have proper lighting, brakes, and reflective equipment, especially at night. While a failure to meet these requirements could be used by insurers to reduce liability, the law also protects riders who are otherwise following the rules of the road.
