No lawyer can guarantee a recovery, as there are many essential elements to consider when seeking to recover on a claim. First, liability or fault must be determined between the parties. This is a very important step in the claim. If liability cannot be established, recovery will not be possible.

Second, there must be bodily injury or uninsured motorist insurance coverage to make a recovery. Third, Florida requires that there be permanency of injury, meaning you have suffered a permanent injury or aggravation of a previous injury. Fourth, there must be causation regarding the accident that links it to the injury sustained.
