What To Do If You’re In A Car Accident Caused By Livestock On A Road

According to Florida law, owners of livestock who either intentionally or unintentionally allow livestock to run on public roads are responsible for any injuries or damage that occur due to the livestock. With these kinds of cases, we have to prove who the owner is. That is not an easy task.

The law states that ownership of the livestock must be proven. In small, rural farm towns this can be hard because not everyone brands their livestock. In order to have a case for damages, you have to be able to prove that an individual is the owner and that they were negligent. This can be done in a variety of ways such as proving that a pasture gate was left open, or that fences were not kept up.

Take this case, for example: A woman was traveling home on a dark road. She was only traveling about 55 miles per hour when she saw about 4 cattle. She hit her brakes, but was not able to stop in time, and hit the 800 pound cows. The front of her car was completely smashed in, and she received significant injuries. After further investigation, we were able to show that the fences were not maintained properly and that the owner was at fault. Watch the video to learn more.
