How To Get a Divorce In Florida If You Can’t Find Your Spouse

Listen as Florida attorney Linda Gruszynski explains what to do if you want to file for divorce but you don’t know the location of your spouse.

You are married and living in Florida, and want to get a divorce. However, you do not know the whereabouts of your soon-to-be ex-spouse, and you are wondering if you can still get a divorce. You can still get a divorce, but in addition to filing your petition for dissolution of marriage you will have to take extra steps to let your spouse know that he or she is being sued for divorce.

What you will need to file in court is an affidavit of diligent search. The court requires a party who is being sued to get appropriate notice of this fact. You will have to take certain steps required by court, such as checking the Internet and popular social media accounts, calling relatives and friends, calling to his or her work office, checking military records, and possibly other actions as deemed necessary by the court.

You will need to follow these steps to the court’s satisfaction that you’ve done everything you can to find your spouse in order to provide him or her with the petition and notice that you’re filing for divorce. Watch the video to learn more.
